Speeding tickets, running a red light, unsafe lane changes, at-fault car accidents are all considered moving violations and may remain on your driving record for up to 36 months (3 years). A DUI, hit-and-run, and other more serious offenses, however, remain on your record for 10 years.

In California, such serious offenses as a DUI, hit-and-run, driving on a suspended license, and/or speeding over 100 mph can land you two points on your driving record. Other violations, including speeding (below 100 mph), causing an accident, driving in a bicycle lane, violating traffic signals, improper lane usage, illegal passing, etc…can land you one point.

These points are then tallied and will determine whether the California DMV will want to suspend your license for six months for being a negligent operator. Currently, the California point system will suspend your license if you receive four points in one year, or six points in two years, or eight points in three years.

These points are all based on moving violations as they arise from violations committed while your car is in motion. Non-moving violations, nonetheless, do not result in points on your license. Examples of non-moving violations include talking on your cell phone and fix-it tickets (i.e. broken light, tinted windows, no front license plate, or paper work violations such as those regarding your auto insurance or registration).

Although we are an auto insurance agency, we also are human and understand mistakes happen, violations are obtained, and dings on your driving record can add up. That is one reason we are highly sought after.

If you have received a violation, there are things you can do to help clear up your driving record.

For example, according to the National Motorist Association, only one out of twenty drivers contest a ticket. Fighting a ticket, however, can reduce or dismiss your violation. In fact, if you feel you were wrongfully ticketed, or even if you are guilty of an infraction, fighting the ticket can be worth it as there may be mitigating factors to help ease the situation.

Additionally, if you have any “fix-it” tickets make sure to address that as quickly as possible to keep such violations off the radar.

Furthermore, if you have any minor mistakes, you may be eligible for a driver safety course. Although these can be taken at an on-site location, you can also complete these on-line and wipe away the penalty point in its entirety.

Finally, one of the most valuable strategies for clearing up your driving record is expungement. While expungement does not erase your record, it can dismiss a violation. It is best to speak to an attorney regarding expungement if this is the route you wish to take.

But what about from the real estate professional’s perspective? From a loan officer’s and Realtor’s view, it can also be stressful. Think about it, although homeowners insurance is usually mandatory if you have taken out a mortgage on your home, from the LO’s and agent’s perspective it’s just one more debt to add to the DTI ratio. Each additional debt/expense increases the risk of exceeding qualification ratio limits and consequently receiving a loan denial. Not to forget to mention, if the transaction is a purchase and the sales price is a bit stretched, there may be a disconnect between coverage limits and lender requirements.

That said, we also know the value and necessity behind homeowners insurance. Not only does coverage protect the homeowner and lender from losses should the property be damaged, but it protects the homeowner from liability should anyone get hurt on the property. As real estate professionals, this should be clearly communicated across to the client. Insurance is more than just another condition ordered by an underwriter.

So what is a declaration page? In short, insurance companies provide a yearly declaration page, outlining the homeowner’s insurance coverage. The document should show who is insured on the top. This will include the policy number, the coverage period for the insurance, the name of the insured, the name of the lien holder, the property location, and the issuing insurance agency’s name and address.

Afterwards, it should also show what is insured. Also known as the rating information, this section will include details about the property to determine the premium.

Side note, we suggest that you highly recommend to your clients to review this section thoroughly each year and when a change is made to the home (i.e.  obtaining a new roof, alarm, pool, or even adding a new pet can affect your premium).

Another main component is the section indicating how much the homeowner is insured. This will present the early premium, limits, deductibles, as well as the coverages for the dwelling, personal property, unattached structures, personal liability, loss of use benefit, personal liability, and medical payment protection.

The standard protection plan covers:

  1. The Dwelling – This includes the home, attached structure, plumbing, heating and air conditioning, electrical wiring, as well as built-in appliances.
  2. Personal Property – This includes the personal belongings in the home.
  3. Unattached Structures – Examples can include sheds, detached garages, fences, driveways, patios, etc…
  4. Loss of Use Benefit – If an unforeseen event strikes, requiring the homeowner to live elsewhere while repairs are being made, the loss of use benefit will cover some living expenses.
  5. Personal Liability – If someone or their property is injured while hurt on the insured’s property, personal liability coverage will protect the homeowner from financial loss should they be sued.

For that, you should reassess your car insurance policy every 6 months. In fact, cars 5 years or older spend 20% less than newer models.
